ELIGIBILITY: Jif® Moms Voice their Choice Contest™ ("Contest") is open to legal residents of the 50 United States and District of Columbia that are 18 years of age or older at time of entry. The Contest is void outside the 50 United States and District of Columbia and where prohibited. All federal, state, and local laws and regulations apply. The J.M. Smucker Company ("Sponsor") and its subsidiaries, affiliated companies, dealers, wholesalers, advertising and promotion agencies, webmasters/suppliers, employees, officers, and directors, and their respective immediate family members (spouse, parents, siblings, children) or household members (whether or not related) are ineligible. Entrants who are immediate family members (parents, children, siblings) of or who are personally acquainted with Online Finalists in the 7th Annual Jif® Most Creative Peanut Butter Sandwich Contest™ will be disqualified. By entering, entrants agree to abide by and be bound by the Official Rules and by the decisions of the Sponsor, which will be final and binding.
HOW TO ENTER: Between August 4, 2008, 12:00 AM ET and November 14, 2008, 11:59 PM ET ("Entry Period"), access the website at www.jif.com, click on the Promotion banner or link to access the Contest page, and then follow the directions to enter. All Internet entries must be received and recorded by Sponsor's computer (the official Contest time keeping device) by 11:59 PM ET during the Entry Period. When online, entrants will need to enter their full name, address, city, state, zip code, daytime phone number, e-mail address, date of birth; agree to the Official Rules; submit an essay of 250 words or less in English answering either a) How do you (as a Mom) make the best choices for your family? or b) if you are not a Mom, how have you observed a Mom making the best choices for her family? After completing the essay click "Submit Entry." Limit one entry per person/e-mail address. No robotic, programmed, script, macro or other automated entries (collectively "automated entries"). Automated entries, or, multiple entries or entries that have been tampered with will result in disqualification of all such entries. All entry information submitted becomes the property of Sponsor and will not be returned. Once an entry is submitted it cannot be changed, altered or modified.
JUDGING: A qualified panel will judge the essays based on the following criteria: Connection with theme/subject matter (40%), creativity (25%), originality (25%) and style/organization (10%). The judging criteria will use the percentages for each of the above categories for a combined total of 100 points. The Grand Prize Winner will be the essay author, not the subject of the essay. The Grand Prize Winner will be selected after the qualified panel reviews all of the essay submissions from all eligible entries will be chosen on or about February 17, 2009 and notified via telephone or mail. The Grand Prize Winner will be subject to eligibility verification and cannot discuss their status with the public until notified by Sponsor or the public announcement is made. The Grand Prize Winner will be announced to the public on or about February 23, 2009.
PRIZE/APPROXIMATE RETAIL VALUE ("ARV")/ODDS OF WINNING: One Grand Prize: One winner will receive a four day, three night trip for winner and one guest to the 7th Annual Jif Most Creative Peanut Butter Sandwich Contest, scheduled on or about Thursday, March 19 ? Sunday, March 22, 2009 in New York City and a Jif gift basket. The Grand Prize Winner will serve as a judge for the contest. The Sponsor will provide round-trip coach airfare from major airport nearest to the Grand Prize Winner?s U.S. residence and hotel accommodations for him/her and a guest. The Sponsor will also provide standard transportation to/from hotel to airport and to/from hotel to judging event. If the Grand Prize Winner lives within 100 miles of New York, New York, alternate transportation will be provided by the Sponsor. Approximate Retail Value (ARV) is $3,000. Actual value depends on point of origin and time of travel. All other expenses are the responsibility of the Grand Prize Winner. If a winner cannot accept the prize as stated, the prize will be forfeited and awarded to an alternate winner if circumstances permit. Odds of winning depend on the number of eligible entries received.
TERMS AND CONDITIONS: All expenses not specified herein, including but not limited to taxes and gratuities are the sole responsibility of the participants and Grand Prize Winner. Sponsor's decisions will be final on all matters relating to this Contest. The potential Grand Prize Winner will be required to execute an Affidavit of Eligibility, a Liability Release and (where legal) a Publicity Release. If potential Grand Prize Winner fails to return such documents within seven days, or the potential Grand Prize Winner is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential Grand Prize Winner will be disqualified and an alternate Grand Prize Winner will be selected, if circumstances permit. The Grand Prize Winner will also have to make themselves available for media interviews and public relations activities if appropriate. If prizes or prize notifications are returned as undeliverable, this will result in disqualification and an alternate winner will be selected. Prizes are non-transferable. No cash redemptions or substitutions permitted, except by Sponsor who may substitute a prize of equal or greater value if the featured prize or any portion thereof becomes unavailable. All federal, state and local laws and regulations apply. Except where prohibited by law, the entry from the Grand Prize Winner and acceptance of a prize constitutes permission for the Sponsor to use the name, photograph, likeness, essay, statements, biographical information, voice, and city and state address of Grand Prize Winner (collectively "Publicity Materials") on a worldwide basis, and in all forms of media, in perpetuity, without further compensation. Grand Prize Winner agrees that his/her essay or statements may be used in whole or in part and may be paraphrased, amplified, shortened, and/or put into conversational form to meet the requirements of copy, layout and/or script, provided their general sense is not changed, and hereby waive any right to inspect and approve finished Publicity Materials, and Grand Prize Winner will not hold Sponsor responsible for any liability resulting from the use of the Publicity Materials. All Publicity Materials developed or used hereunder will be and remain Sponsor?s property, and Grand Prize Winner specifically understands and agrees that any copyrightable Publicity Materials will be works ?made for hire? and Grand Prize Winner will retain no ownership rights whatsoever in or to said works. If said Publicity Materials are not considered works, ?made for hire,? Grand Prize Winner hereby assigns all said works to Sponsor. All participants and Grand Prize Winner also agree to release, discharge, indemnify and hold harmless Sponsor, its affiliates and subsidiaries, and each of their respective officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages, or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest. The Sponsor may prohibit any entrant from participating in this Contest at its sole discretion, if an entrant shows a disregard for the Official Rules or acts: (a) in a manner Sponsor determines to be unfair or inequitable, including but not limited to tampering with this Contest or this Contest Website; (b) with an intent to annoy, threaten or harass any other entrant or the Sponsor; or (c) in any other disruptive or illegal manner. Sponsor reserves the right in its sole discretion to cancel, terminate or suspend this Contest should electronic viruses, other malicious software attacks, unauthorized human intervention, systems malfunctions, failures, difficulties or other causes beyond the control of the Sponsor and its agencies corrupt or affect the administration, security, fairness or proper play or conduct of this Contest. In such event, Sponsor will conduct this Contest in accordance with the Official Rules in a manner deemed fair, proper and equitable by Sponsor, in its sole discretion.
LIMITATIONS OF LIABILITY: Neither Sponsor nor its agencies are responsible for lost, late, stolen, illegible, misdirected, mutilated, incomplete, or non-delivered entries; or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), Website or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information. Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by Website users, or by any equipment or programming associated with or utilized in this Contest and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Website. Any attempt to deliberately damage any Website or undermine the legitimate operation of this Contest is unlawful and subject to legal action by Sponsor or its agents.
IN NO EVENT WILL SPONSOR, ITS AFFILIATES, SUBSIDIARIES OR RELATED COMPANIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANTS ACCESS TO OR USE OF THE CONTEST WEBSITE OR DOWNLOADING FROM OR PRINTING MATERIAL DOWNLOADED FROM SAID WEBSITE OR PARTICIPATING IN THIS CONTEST. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEBSITE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
